Apple sued for allegedly underpaying female employees

Two women have filed a class-action lawsuit against Apple, seeking damages for 12,000 current and former female employees over alleged underpayments. It said the tech giant “systematically” paid them less than male employees over a four-year period.

The lawsuit, filed Thursday in San Francisco County Court in California, alleges that Apple’s systemic gender discrimination stems from a policy that sets wages based on employees’ prior employment, according to the company. .

The complaint alleges that prior to the fall of 2017, Apple used previous salary criteria provided by job applicants to set their starting salaries. The next year, Apple asked job candidates about their salary expectations. The lawsuit alleges that both practices resulted in lower pay for women in the workplace. It also claims that the latter’s policy of asking prospective employees about their salary expectations “is highly correlated with previous salaries; research shows that people who are asked about their salary expectations often provide figures that are slightly higher than what they were paid in their current or previous job.”

The lawsuit alleges that job seeker pay policies created a pattern of lower pay for female employees: “Apple’s policy or practice of collecting information about salary expectations and using that information to set starting salaries has perpetuated past pay disparities, and resulting in lower pay for female employees.

The lawsuit further alleges that Apple regularly punishes female employees because performance “rating categories” drive salary bonuses and growth.

“Apple’s performance review system is biased against women because men are rewarded and women are punished for the same behaviors in scoring categories such as teamwork and leadership,” the complaint reads.

The class action lawsuit seeks damages and “declaratory relief,” as well as reimbursement of low income and benefits resulting from Apple’s alleged disparities. The plaintiffs also asked the court to hold a jury trial to hear their claims.
